This Privacy Policy (“Policy”) applies to www.pink-filters.com (or “Site”) and the Pink Filters Service (or “Service”) provided by Friendship L.L.C. (or “Company”), and governs data collection and usage. For the purposes of this Privacy Policy, unless otherwise noted, all references to the Company include the Site and the Service. The Site is a social networking site. By using the Site, you consent to the data practices described in this statement.

1. COLLECTION OF YOUR PERSONAL INFORMATION
In order to better provide you with products and services offered, the Company may collect personally identifiable information, such as your:

We do not collect any personal information about you unless you voluntarily provide it to us. However, you may be required to provide certain personal information to us when you elect to use certain products or services. These may include: (a) registering for an account; (b) entering a sweepstakes or contest sponsored by us or one of our partners; (c) signing up for special offers from selected third parties; (d) sending us an email message; (e) submitting your credit card or other payment information when ordering and purchasing products and services. To wit, we will use your information for, but not limited to, communicating with you in relation to services and/or products you have requested from us. We also may gather additional personal or non-personal information in the future.

For users who are California residents, the data we may collect falls within the following categories of “personal information”, as defined by the California Consumer Privacy Act (CCPA):

Profile Information

We recommend and encourage you (and all our members) to think carefully about the information you disclose about yourself to others and in your Pink Filters individual profile. We do not recommend that you put email addresses, URLs, instant messaging details, phone numbers, full names or addresses, credit card details, national identity numbers, driver’s license details and other sensitive information which is open to abuse and misuse on your profile.

When you post information about yourself or use the messaging function to communicate with other users, the amount of personal information you share is at your own risk. Please see Section 5 below for more information on who can access what you post on Pink Filters.

Profile Verification Information

For safety and security and to ensure you have the best possible user experience, we may require users to verify their accounts. We might ask for your phone number and, in some instances, we might also ask that you carry out a photo verification. We want to confirm that you are not a robot and that your face and information you submit through verification matches that in your Pink Filters profile. We also want to avoid fake Pink Filters accounts being created which can be used for malicious activities and cybercrime, as they threaten the Site and spoil things for everyone. This verification might be required by us for the prevention of fraud. You can also verify your account on a voluntary basis to add the blue “ID VERIFIED” badge to your profile.

If you choose to verify your account, we will refer you to our partner Proof to conduct the identity verification. The verification may include photo id verification, identify questions, and/or a live notary that acts as a referee to review your documents and complete the verification. Your information will be stored on Proof’s servers as permitted by data storage laws. Please visit www.proof.com to review their Terms and Privacy Policy.

Automatically Collected Information
The Company may automatically collect information about your computer hardware and software. This information can include your IP address, browser type, domain names, access times, and referring website addresses. This information is used for the operation of the service, to maintain quality of the service, and to provide general statistics regarding the use of the Company’s website.

Use of Cookies
The Company’s website may use “cookies” to help you personalize your online experience. A cookie is a text file that is placed on your hard disk by a web page server. Cookies cannot be used to run programs or deliver viruses to your computer. Cookies are uniquely assigned to you, and can only be read by a web server in the domain that issued the cookie to you.

One of the primary purposes of cookies is to provide a convenience feature to save you time. The purpose of a cookie is to tell the web server that you have returned to a specific page. For example, if you personalize the Company’s pages, or register with Company’s site or services, a cookie helps the Company to recall your specific information on subsequent visits. This simplifies the process of recording your personal information, such as billing addresses, shipping addresses, and so on. When you return to the same website, the information you previously provided can be retrieved, so you can easily use the Company’s features that you customized.

2. USE OF YOUR PERSONAL INFORMATION

Tracking User Behavior
The Company may keep track of the websites and pages our users visit within the Company, in order to determine what of the Company services are the most popular. This data is used to deliver customized content and advertising within the Company to customers whose behavior indicates that they are interested in a particular subject area.

Two-Factor Authentication

We use Two-Factor Authentication to secure the login screen of the Site. When you or someone else attempts to log in to your account, we track the city, state, country, and IP address of the person attempting the log in. If the password is successfully entered, we send a link to the registered email address to complete the login. In the email, we provide the IP address and login time of the log in attempt.

Geolocation Information

If you have given the Site access to your location in your device settings, when you use your mobile, we will collect information about WiFi access points as well as other location information about your longitude and latitude and may save your device’s coordinates to offer certain features to you. This information helps us identify your physical location and we use it to personalize the App and make it easier for you to interact with other users, by enabling the general locality information to be displayed to users seeing your profile and showing you the profiles of other users who are near you.

If you have given the Site access to your location, but wish to turn this off, you may do so in your device’s internet browser settings.

Use of Algorithms and Recommender Systems

We do not use any algorithms to predict your compatibility with other users. We give users the ability to search and/or browse a member directory containing all registered users on the Site (who have an active account) and full control over determining which users they are potentially compatible with based on the information in the users’ individual profiles.

Use of Information

In order to deliver an enjoyable experience to you, we may use your Registration and other information to:

  • offer you our services and features;
  • contact you with information about the Site and the Service (e.g., updates and new features);
  • personalize the Site, the Service, and the content we deliver to you;
  • conduct research and analytics about how you use and interact with the Site and the Service;
  • to test new technologies and processes designed to enhance and improve the Site and the Service;
  • resolve disputes, troubleshoot problems and to enforce our Terms of Use;
  • investigate fraud, protect our legal rights, and to enforce our Terms of Use;
  • to send you information about the promotions and offers we have available (e.g., specify the types of goods/services/offers to be provided via direct marketing) by direct marketing or other modes of communication – if you’ve signed up for our communications or otherwise told us it’s OK. We will not use your information in email direct marketing unless you give us your consent during the Account creating process or via Settings in the Site after logged-in (you can withdraw from marketing at any time by using the opt-out mechanisms and links provided in each message); and
  • protect our users and third parties from harm.

Sharing Information with Third Parties
The Company does not sell, rent, or lease its customer lists to third parties.

The Company may, from time to time, contact you on behalf of external business partners about a particular offering that may be of interest to you. In those cases, your unique personally identifiable information (email, name, address, phone number) is transferred to the third party. The Company may share data with trusted partners to help perform statistical analysis, send you email or postal mail, provide customer support, or arrange for deliveries. All such third parties are prohibited from using your personal information except to provide these services to the Company, and they are required to maintain the confidentiality of your information.

The Company may disclose your personal information, without notice, if required to do so by law or in the good faith belief that such action is necessary to: (a) conform to the edicts of the law or comply with legal process served on the Company or the site; (b) protect and defend the rights or property of the Company; and/or (c) act under exigent circumstances to protect the personal safety of users of the Company, or the public.

Opt-Out of Disclosure of Personal Information to Third Parties
In connection with any personal information we may disclose to a third party for a business purpose, you have the right to know:

3. MODERATION PRACTICES
We use a combination of automated systems, user reports and a team of moderators to monitor and review accounts and content to identify breaches of these Terms. We reserve the right at our sole discretion to terminate or suspend any Account, restrict access to the Site, or make use of any operational, technological, legal or other means available to enforce the Terms (including without limitation blocking specific IP addresses).


4. DISCLOSURE OF INFORMATION

Our policy is to not disclose your Registration Information or personal data, except in the limited circumstances described here:

This may include where there is an investigation into alleged criminal behavior or to protect the vital interests of a person. We may preserve or disclose any of your information, including your Registration Information, if we believe in good faith that it is necessary to comply with a law or regulation, or when we believe in good faith that disclosure is necessary: to comply with a binding direction court order, or lawful request; to protect the safety of any person; to address fraud, security or technical issues e.g. through anti-spam providers to protect the service from criminal activity; or to protect our rights or property or those of third parties. 5. WHAT OTHERS MAY SEE ABOUT YOU.

We want to give you the ability to find and connect with the people you are mostly likely to vibe with. We have built certain features to enable this and make it easier for you to connect and interact with these users.

When using the Site, you should assume that anything you post or submit on the Site may be publicly-viewable and accessible by users of the Site. We want our users to be careful about posting information that may eventually be made public.

Pink Filters profiles provide as much information about a user up front, so that users can make an informed decision about whether or not a friendship with another user is feasible.

Profile field visibility. Please consider that most of the information in your profile is viewable by all users of the Site.

Your Last Name is hidden and the visibility cannot be changed.

You can change the visibility of the following profile fields: First Name, Career, Social Media, Website URL, and Additional Information, in the Account section of your Profile.

Profile field visibility is critical to our business model that provides users transparency into potential friends and is intended to reduce the chance of ghosting. If you are not comfortable with the visibility settings we’ve programmed in the Site, do not register on the site.

Please note that if you upload and choose to share sensitive information (such as religious beliefs, sexuality and political affiliation), you are explicitly consenting to sharing that information with other users on the Site.

Posts. Users many change the visibility setting for a Timeline or News Feed post before posting it or any time after posting it.

Photos. Please remember that photographs that you post on the Site may reveal information about yourself as well. Where you do upload and choose to tell us sensitive information about yourself, including through the addition of badges to your profile, you are explicitly consenting to our processing of this information and making it public to other Users.

Your Pink Filters profile and other information you make available via the Site, including certain information added to your profile through third party accounts (such as Facebook, Instagram or LinkedIn) may be viewed and shared by Users with individuals who may or may not be Users of the Site. For example, a User may recommend you as a match to his or her Facebook friend(s) by taking a screenshot of your profile picture and sharing it, regardless of whether such friend(s) is also a User of Pink Filters.

If you log in to or access Pink Filters through your Facebook account or another third-party account on a device which you share with others, remember to log out of Pink Filters and the relevant third-party account when you leave the device in order to prevent other users from accessing your Pink Filters account.

Groups. We offer groups and forums that members can join to discuss pre-determined topics that interest them. Anything you post in group or forum will be visible by other members of that group or forum.

This website contains links to other sites. Please be aware that we are not responsible for the content or privacy practices of such other sites. We encourage our users to be aware when they leave our site and to read the privacy statements of any other site that collects personally identifiable information.

6. OUR POLICY TOWARDS AGE.
We do not knowingly collect any information about or market to children, minors or anyone under the age of 18. If we become aware that a child, minor or anyone under the age of 18 has registered with us and provided us with personal information, we will take steps to terminate that person’s registration.

7. YOUR CALIFORNIA PRIVACY RIGHTS.

For users who are California residents, you have the following rights (in addition to those listed at section 15 below) under the California Consumer Privacy Act, and you have the right to be free from unlawful discrimination for exercising your rights under the Act:

  1. You have the right to request that we disclose certain information to you and explain how we have collected, used and shared your personal information over the past 12 months.
  2. You have the right to request that we delete your personal information that we collected from you, subject to certain exceptions.

California’s “Shine the Light” law, Civil Code section 1798.83, requires certain businesses to respond to requests from California customers asking about the businesses’ practices related to disclosing personal information to third parties for the third parties direct marketing purposes. From time to time, as part of a joint promotion with a third party, we may, if you participate in such promotion, disclose your contact information to the third party to allow them to market their products or services to you. Where this is a condition for participation in a promotion, we will always let you know before when you enter the promotion. Please follow the instructions provided to you by third parties to unsubscribe from their messages.

In addition, under California law, operators of online services are required to disclose how they respond to “do not track” signals or other similar mechanisms that provide consumers the ability to exercise choice regarding the collection of personal information of a consumer over time and across third party online services, to the extent the operator engages in that collection. At this time, we do not track our users’ personal information over time and across third-party online services. This law also requires operators of online services to disclose whether third parties may collect personal information about their users’ online activities over time and across different online services when the users use the operator’s service. We do not knowingly permit third parties to collect personal information about an individual user’s online activities over time and across different online services when using the Site.

8. SECURITY OF YOUR PERSONAL INFORMATION
The Company secures your personal information from unauthorized access, use, or disclosure. The Company uses the following methods for this purpose:

When personal information (such as a credit card number) is transmitted to other websites, it is protected through the use of encryption, such as the Secure Sockets Layer (SSL) protocol.

We strive to take appropriate security measures to protect against unauthorized access to or alteration of your personal information. 9. SECURITY

We pride ourselves on taking all appropriate security measures to help protect your information against loss, misuse and unauthorized access, or disclosure. We use reasonable security measures to safeguard the confidentiality of your personal information such as secured servers using firewalls.

Unfortunately, no website or Internet transmission is ever completely 100% secure and even we cannot guarantee that unauthorized access, hacking, data loss or other breaches will never occur, but here are some handy tips to help keep your data secure:

  1. Please make sure you fully log out of your Account after use as you never know who may stumble onto your Account! Pay attention to the logout confirmation screen.
  2. Please don’t share the password you use to access your Pink Filters Account with anyone else!
  3. Change your password periodically.
  4. Pay attention to any email with the subject: Login confirmation for Pink-Filters.com. This is an indication that you or someone has attempted to log into your account. Follow the instructions in the email.

If you ever think someone has had access to your password or Account, please follow the steps set out here. We cannot guarantee the security of your personal data while it is being transmitted to our site and any transmission is at your own risk.

10. RIGHT TO DELETION
You can delete your Account at any time by going to the “Account” page when you are logged in and clicking on the “Request Account Deletion” tab. Your profile will no longer be visible on the site, but it may take a time period for Your Content (defined below) to be completely removed from the Site. Your profile information will be treated in accordance with our Privacy Policy.

Subject to certain exceptions set out below, on receipt of a verifiable request from you, we will:

-Delete your personal information from our records; and

-Direct any service providers to delete your personal information from their records.

Please note that we may not be able to comply with requests to delete your personal information if it is necessary to:

-Complete the transaction for which the personal information was collected, fulfill the terms of a written warranty or product recall conducted in accordance with federal law, and provide a good or service requested by you, or reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform a contract between you and us;

-Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity; or prosecute those responsible for that activity;

-Debug to identify and repair errors that impair existing intended functionality;

-Exercise free speech, ensure the right of another consumer to exercise his or her right of free speech, or exercise another right provided for by law;

-Comply with the California Electronic Communications Privacy Act;

-Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when our deletion of the information is likely to render impossible or seriously impair the achievement of such research, provided we have obtained your informed consent;

-Enable solely internal uses that are reasonably aligned with your expectations based on your relationship with us;

-Comply with an existing legal obligation; or

-Otherwise use your personal information, internally, in a lawful manner that is compatible with the context in which you provided the information.


11. DATA RETENTION AND DELETION.

We keep your personal information only as long as we need it for the legal basis relied upon (as set out in Section 2 above) and as permitted by applicable law.

When your Account is deleted, we make sure it is no longer viewable in the Site. For up to 28 days, it is still possible to restore your Account if it was accidentally deleted. After 28 days, we begin the process of deleting your personal information from our systems, unless:

  1. we must keep it to comply with applicable law (for instance, if you make purchases within the Site, some personal data may be kept for tax and accounting purposes);
  2. we must keep it to evidence our compliance with applicable law (for example, if an account is blocked, we keep some account information and a record of the behavior that led to the block – this information is retained for evidential purposes in case of queries or legal claims concerning the block);
  3. there is an outstanding issue, claim or dispute requiring us to keep the relevant information until it is resolved; or
  4. the information must be kept for our legitimate business interests, such as fraud prevention and enhancing users’ safety and security (for example, information may need to be kept to prevent a user who was banned for unsafe behavior or security incidents from opening a new account).

Warning: Even after you remove information from your profile or delete your Account, copies of that information may still be viewable and/or accessed to the extent such information has been previously shared with others, or copied or stored by others. We cannot control this, nor do we accept any liability for this. If you have given third party applications or websites access to your personal information, they may retain such information to the extent permitted under their terms of service or privacy policies.

12. OUR POLICY AROUND AGE

Persons Under Thirteen

The Company does not knowingly collect personally identifiable information from children under the age of 13. If you are under the age of 13, you may not use the site.

Persons Under Eighteen
The Company does not knowingly collect personally identifiable information from children under the age of 18. If you are under the age of 18, you may not use the site.

Opt Out and Unsubscribe from Third-Party Communications

We respect your privacy and give you an opportunity to opt out of receiving announcements of certain information. Users may opt out of receiving any or all communications from third-party partners of the Company by click the link in the footer in the email. 13. EMAIL COMMUNICATIONS
From time to time, the Company may contact you via email for the purpose of providing announcements, promotional offers, alerts, confirmations, surveys, and/or other general communication. In order to improve our services, we may receive a notification when you open an email from the Company or click on a link therein.

If you would like to stop receiving marketing or promotional communications via email from the Company, you may opt out of such communications by clicking Unsubscribe at the bottom of the email.

14. EXTERNAL DATA STORAGE SITES
We may store your data on servers provided by third-party hosting vendors with whom we have contracted.
